 Release and Indemnification Agreement

1. Consent for Participation and Waiver of Responsibility

I, the undersigned, willingly apply for enrollment and involvement in martial arts training activities hosted by NEW VALOR BJJ Academy. At this moment, I absolve NEW VALOR BJJ Academy, its proprietors, instructors, staff, representatives, volunteers, affiliates, shareholders, board members, and authorized guests, whether individually or collectively, from any liabilities or claims arising from injury, accident, fatality, or losses, whether physical, mental, or emotional, that I may encounter while attending classes, training sessions, seminars, tournaments, or events. I hold the parties above harmless in the event of personal injury or harm caused to another person, whether through accidental, intentional, malicious, regular, or abnormal application of techniques utilized before, during, or after said activities. I acknowledge the inherent risks of such activities, including the potential for injury or fatality, and willingly assume all associated risks.

Furthermore, I agree to personally cover any potential future medical expenses resulting from injuries sustained during my participation in the above activities. I grant permission for trained medical professionals to administer emergency medical aid should illness, injury, or accidents occur. I affirm that I am covered by health insurance that will address any injuries I may sustain during my training.

As an additional condition for training at NEW VALOR BJJ Academy, I consent to the possibility of my presence and performance at the Academy and related events being photographed, filmed, or recorded for marketing purposes, thereby waiving any entitlement to compensation, even in the event of discontinuing my training. I acknowledge my desire to receive communication from the Academy via telephone, mail, and email. I am fully aware of the risks and dangers inherent in participating in this form of martial arts and agree to abide by all associated rules, terms, and conditions. I have received and understood a copy of NEW VALOR BJJ Academy's regulations and training guidelines and pledge to adhere to them. I understand that violating these rules may result in suspension or expulsion from NEW VALOR BJJ Academy without a refund. If expelled, I am liable to fulfill any remaining contractual obligations, if applicable. By signing this release, I acknowledge and affirm that I have read and comprehended its contents and sign it voluntarily, being of sound mind and at least 18 years of age. If under 18, a parent/legal guardian also agrees to the terms and conditions outlined herein.

Moreover, I grant NEW VALOR BJJ Academy, its employees, and agents permission to capture and utilize visual/audio images of me, including but not limited to photographs, digital images, recordings, voices, videos, or accompanying descriptions. I acknowledge NEW VALOR BJJ Academy's ownership of these images and all related rights, authorizing their use in any manner or media without prior notification to me, including but not limited to websites, social media, publications, advertisements, and promotional materials. I waive any right to review or approve the final images or associated materials and release NEW VALOR BJJ Academy, its employees, and agents from any claims or liabilities arising from the capture or use of said images or materials. I confirm that I am at least 18 years of age, competent to sign this release, and have done so with complete understanding and acceptance of its terms.

2. Acknowledgment of Risk and Liability Waiver Concerning Coronavirus/COVID-19

I acknowledge that COVID-19, the novel coronavirus, has been recognized as a global pandemic by the World Health Organization. COVID-19 is highly contagious and is primarily transmitted through person-to-person contact. Consequently, governmental and health authorities at the federal, provincial, and local levels have advised social distancing measures and, in many instances, have restricted the gathering of individuals in groups.

While NEW VALOR BJJ Academy ("the Academy") has implemented preventive measures to mitigate the spread of COVID-19, it cannot guarantee that neither my child(ren) nor I will avoid contracting the virus. Attending the Academy carries inherent risks and may heighten the likelihood of contracting and transmitting COVID-19 to others.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the associated risks, including the potential for personal injury, illness, permanent disability, or death. I understand that the risk of exposure to or infection by COVID-19 may result from my actions and the actions of others, including but not limited to Academy employees, volunteers, program participants, and their families, and I agree to bear complete responsibility for such risks.

Consequently, I willingly accept all risks associated with COVID-19 exposure and absolve the Academy, its employees, agents, and representatives from any liability or claims, including but not limited to personal injury, disability, death, illness, damages, losses, or expenses of any kind, arising from my or my child(ren) 's attendance at the Academy or participation in its programming. On behalf of myself and my child(ren), I release, waive any right to sue, and discharge the Academy, its employees, agents, and representatives from all claims and liabilities, irrespective of whether they arise from the negligence or omissions of the Academy, its employees, agents, or representatives, whether before, during, or after participation in any Academy program.
